General Terms and Conditions of Sale
The sale of products on this site is governed by these General Terms and Conditions of Sale, in accordance with Italian legislation, in particular Legislative Decree 70/2003 on electronic commerce and Legislative Decree 206/2005 on distance contracts. The detailed procedures in the various sections of the site are an integral and substantial part of the sales contract. Customers are advised to read these conditions carefully before placing an order, and to print or save them for future reference.
Any changes to the Conditions of Sale will be promptly communicated to customers and will only be applicable to orders placed after their publication. By placing your order, you agree to the terms and conditions of sale in force at the time.
Conclusion of the Contract
The order placed through the site by the customer must be complete in all its parts, including the information necessary for the identification of the customer, the products ordered and the delivery address. Otherwise, the order will be considered null and void. Rossi Carta srl Unipersonale will confirm receipt of the order by e-mail, including a reference to the applicable conditions of sale.
Features and Availability of Products
In some circumstances, Rossi Carta srl Unipersonale may not be able to guarantee the availability of all the products offered. It cannot be held responsible for the temporary unavailability of one or more products. Except as provided for in the "Right of withdrawal" chapter, the sending of the order constitutes acceptance by the customer of any partial delivery, limited to the products available, without the right to request compensation or indemnity.
The availability of the products indicated on the website is to be considered purely indicative. Since multiple users may be purchasing the same product at the same time, products may be out of stock even after the order is confirmed. In this case, the order will be modified with the deletion of the unavailable product, and the customer will be informed by e-mail. If you decide to cancel your order, we will refund you within 10 days of notifying you of the termination of the contract.

Delivery
Rossi Carta srl Unipersonale delivers the ordered products under the conditions specified in the dedicated section of the website.
Prices and Payment Methods
The prices indicated in the various sections of the site do not include VAT. The applicable prices are those indicated at the time of ordering. Prices may be subject to change, cancelling and replacing those previously indicated. Payment of the price of the products purchased, together with the delivery costs, must be made in accordance with the methods indicated on the website.
Warranties and Liability
Rossi Carta srl Unipersonale guarantees, within the limits of availability, the delivery of products that comply with those described on the site. For all products sold, the responsibility lies with the manufacturer, including the truthfulness and completeness of the information on the packaging. Product images are provided to facilitate customer choice, but may not accurately reflect the final appearance of the delivered product due to variations by the manufacturer.
Disputes and Applicable Law
Disputes relating to the application, execution and interpretation of the sales contract are subject to Italian jurisdiction. The territorial jurisdiction for BTC sales to Italian private individuals will be of the customer's place of residence or domicile. For sales in addition to the Italian territory BTB and BTC , the single, exclusive and competent court will be the Italian court of Forlì and regulated exclusively by Italian law. For anything not expressly provided, the provisions of Italian law on the subject apply.
Delivery, Shipping and Returns
Rossi Carta single-member srl, hereinafter simply RossiCarta accepts only orders that provide for delivery on the E.U. territory at the economic conditions described in the cart at the time of purchase.
Shipping costs are indicated on the homepage and in each individual cart and confirmed by email after placing the order.
Some products with large volumes may be subject to different shipping costs and in any case described at the time of the order and confirmed with a special email after placing the order.
Rossi Carta always confirms the acceptance of the order by sending an automatic summary e-mail to the e-mail address indicated by the Customer in the order itself.
For all products delivered, RossiCarta, on request, issues a tax document with the data provided by the Customer.
RossiCarta prepares the goods contained in the order and entrusts them to the courier with the original packaging of the manufacturer if present and/or with recycled cardboard boxes or sealed and suitably closed envelopes.
Deliveries are made on working days, Monday to Friday, not holidays (hereinafter "Working Day(s)"). Hours means the hours included in the Business Days. Rossi Carta uses the following couriers: BRT, SDA or, to ensure an even better service, other couriers chosen for area opportunities.
The delivery times of the Courier to the Customer's home or headquarters are in any case to be considered indicative as they may be subject to change due to force majeure, uncomfortable traffic and road conditions, strikes or acts of the Authority.
Delivery costs are generally borne by the Customer and are detailed in each individual "type of delivery" chosen.
At the time of delivery of the goods by the Courier, the Customer is required to check:
a) that the number of packages delivered corresponds to that indicated in the Courier's accompanying document
b) that the packaging is intact, not damaged, nor wet or in any way altered.
In the event that the courier, at the time of delivery, presents the ordered products in packaging that is not perfectly intact, the Customer is required to place a reservation by signing the delivery note writing "subject to subsequent control".
Our products are sent by courier and delivered directly to the address indicated by the customer.
Orders received or confirmed by 3.00 p.m. on working days generally leave within 24 hours. Delivery times are different for each destination but in any case usually 2/3 working days (4/5 for islands and other particular destinations) following the departure of the packages. On Saturdays and Sundays and holidays we do not deliver and do not ship.
It is always necessary to enter, at the time of ordering, an address and a telephone number where the courier can always find someone from 9.00 to 17.00. However, the Courier does not usually make telephone advance notices and the time of delivery is at its discretion.
Returns and Unconditional Right of Withdrawal
Pursuant to art. 52 et seq. of the Consumer Code (Legislative Decree 206/2005 https://www.mimit.gov.it/it/mercato-e-consumatori/tutela-del-consumatore/codice-del-consumo ) the private customer (BTC sale) has a period of 14 days from receipt of the goods to withdraw from the purchase contract concluded through the use of electronic platforms, without having the obligation to provide any reason.
To exercise the right of withdrawal, the consumer can and must return the purchased products already received to obtain a refund. For any further details, please refer to the official government website https://www.mimit.gov.it/it/
In the case of sale to professionals, to be understood as BTB sales, identifiable by sale with a tax invoice, and therefore holders of a VAT number, the right of withdrawal is excluded again pursuant to Legislative Decree no. 206/2005 ( Consumer Code https://www.mimit.gov.it/it/mercato-e-consumatori/tutela-del-consumatore/codice-del-consumo). Therefore, only in the latter case, returns will not be accepted in any way.
Procedures for exercising the unconditional right of withdrawal The right of withdrawal, in any case only for private consumers, must be exercised exclusively by written communication to shop@rossicarta.it expressing the desire to exercise the right itself and providing the following data:
• Order number
• In case of partial withdrawal, description and quantity of the products to be returned
• Bank details of the current account to which the refund transfer is to be obtained (CAB CODE - ABI CODE - BANK ACCOUNT or better IBAN).
• PayPal account details on which to obtain a full or partial refund.
To exercise the right of withdrawal, the product must be in perfect condition, accompanied by its original packaging and must not have been used.
The refund of the amount already paid and corresponding to the entire order (excluding the contribution to shipping costs which therefore remain the responsibility of the buyer) or to that part of the products for which the product has been withdrawn, will be made in the chosen manner and free of charge, within 14 days of the shipment of the goods by the consumer after checking the integrity of the returned products, intact and in their original packaging and any manuals, without any deficiency.
If the above procedures for the withdrawal and return of the goods are not respected, RossiCarta srl Unipersonale reserves the right not to accept the withdrawal itself and not to make the refund, without prejudice to compliance with the legal obligations incumbent on it.
Items excluded from the right of withdrawal
The following are excluded from the right of withdrawal:
• All products requested by the customer and made to measure such as, for example, all personalizzati items (shoppers, ribbons, labels, etc.)
• Items outside the catalogue supplied upon specific order
• Food products (sugared almonds, etc.).
